This Privacy Policy explains how Fullcourt, SIA ("Fullcourt," "we," "us," or "our"), the registered Fullcourt entity, collects, uses, and shares Your information when You access and use Fullcourt’s website, applications, and other offerings from Fullcourt (collectively, the “Fullcourt Platform”). It also tells You about Your privacy rights and how the law protects You, in particular, the General Data Protection Regulation (GDPR) (EU) 2016/679.

We use Your Personal Data to provide and improve the Service. By using the Service, You agree to the collection and use of information as described in this Privacy Policy.

Summary

  • We only collect the information You choose to give us, or information that is necessary to provide the Service. We process it with Your consent, or on another legal basis explained below.

  • We only ask for the minimum amount of personal data that is necessary for You to use our Service.

Words with capitalized initial letters have specific meanings defined below. These definitions apply whether the words are used in singular or plural form.

For this Privacy Policy:

  • Account means a unique account created for You to access our Service.

  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.

  • Application means the Fullcourt software program provided by the Company or downloaded by You on any electronic device.

  • Company (referred to as "the Company", "We", "Us", or "Our") refers to Fullcourt, SIA, an incorporated entity.

  • Cookies are small files placed on Your computer, mobile device, or any other device by a website, containing details of Your browsing history on that website.

  • Country refers to: EU.

  • Device means any device that can access the Service, such as a computer, cellphone, or digital tablet.

  • Personal Data is any information that relates to an identified or identifiable individual.

  • Processing means any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

  • Service refers to the Fullcourt Application.

  • Service Provider means any natural or legal person who processes data on behalf of the Company. This includes third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how the Service is used.

  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

  • You mean the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

2. Collecting and Using Your Personal Data

2.1. Legal Basis for Processing Personal Data

We process Your Personal Data based on one or more of the following legal bases:

  • Consent: You have given clear consent for Us to process Your Personal Data for a specific purpose.

  • Contract: Processing is necessary for a contract We have with You, or because You have asked Us to take specific steps before entering into a contract.

  • Legal obligation: Processing is necessary for Us to comply with the law (not including contractual obligations).

  • Legitimate interests: Processing is necessary for Our legitimate interests or the legitimate interests of a third party, unless there is a good reason to protect Your Personal Data which overrides those legitimate interests.

2.2.1. Personal Data

While using Our Service, We may ask You to provide Us with certain Personal Data that can be used to contact or identify You. Personal Data may include, but is not limited to:

  • First name and last name

  • Address, State, Province, ZIP/Postal code, City

  • Information relating to Your payment instrument(s) such as the number of Your payment instrument(s) and the expiration date of Your payment instrument(s) (required for the purposes of booking a court via the Fullcourt Platform, however not stored by Fullcourt, since Fullcourt uses a third-party payment service provider for processing payments)

  • Booking details (e.g., court booked, time, duration)

Why We Collect This Data:

  • We collect Your email address, name, and contact details to create and manage Your account, to communicate with You about Your bookings, and to provide customer support. The legal basis for this processing is the performance of a contract with you.

  • We collect Your payment information to process bookings and payments. The legal basis for this processing is the performance of a contract with you.

  • We collect booking details to manage and record your court bookings. The legal basis for this processing is the performance of a contract with you and Our legitimate interest in managing our business operations.

2.2.2. Usage Data

Usage Data is collected automatically when You use the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g., IP address), browser type, browser version, the pages of Our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device's unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers, and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Why We Collect This Data:

  • We collect Your IP address and other technical data to administer and secure our Service, to analyze trends, and to help diagnose problems with our servers. The legal basis for this processing is Our legitimate interest in ensuring the security and proper functioning of our Service.

  • We analyze usage data to improve and optimize our Service. The legal basis for this processing is Our legitimate interest in developing and improving our Service.

2.2.3. Information Collected While Using the Application

While using Our Application, in order to provide certain features, We may collect, with Your prior permission:

  • Information regarding Your location

  • Pictures and other information from Your Device's camera and photo library

We use this information to provide features of Our Service, to improve and customize Our Service.

The information may be uploaded to the Company's servers and/or a Service Provider's server, or it may be simply stored on Your device.

You can enable or disable access to this information at any time through Your Device settings.

Why We Collect This Data:

  • We collect location data to help You find sports courts near you and to provide location-based services. We only collect this data with your explicit consent, which you can grant or withdraw through your device settings.

  • We only access your device's camera and photo library with your explicit consent and solely for the purpose of enabling features within the app that require access to these functions (e.g., uploading a profile picture).

3. Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including to monitor the usage of our Service.

  • To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide gives You access to different functionalities of the Service that are available to You as a registered user.

  • For the performance of a contract: the development, compliance, and undertaking of the purchase contract for the products, items, or services You have purchased or of any other contract with Us through the Service.

  • To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products, or contracted services, including security updates, when necessary or reasonable for their implementation.

  • To provide You with news, special offers, and general information about other goods, services, and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.

  • To manage Your requests: To attend to and manage Your requests to Us.

  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.

  • For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, and to evaluate and improve our Service, products, services, marketing, and Your experience.

4. Sharing Your Personal Data

We may share Your personal information in the following situations:

  • With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, and to contact You. We only share the Personal Data that is necessary for these Service Providers to perform their services for us.

  • For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company. In such cases, Your Personal Data will be transferred in accordance with applicable data protection laws.

  • With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners, or other companies that We control or that are under common control with Us.

  • With other users: when You share personal information or otherwise interact in public areas with other users, such information may be viewed by all users and may be publicly distributed outside.

  • With Your consent: We may disclose Your personal information for any other purpose with Your consent.

  • Legal Disclosure: We may disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency). We may also disclose Your Personal Data in the good faith belief that such action is necessary to:

    • Comply with a legal obligation

    • Protect and defend the rights or property of the Company

    • Prevent or investigate possible wrongdoing in connection with the Service

    • Protect the personal safety of Users of the Service or the public

    • Protect against legal liability

5. Retention of Your Personal Data

We will keep Your Personal Data only for as long as needed for the purposes set out in this Privacy Policy.

We will keep and use Your Personal Data as necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also keep Usage Data for internal analysis. Usage Data is generally kept for a shorter period, except when this data is used to make the Service more secure or to improve how it works, or when We are legally required to keep the data for a longer period.

  • Most personal data relating to a Member's account with Fullcourt will be deleted 90 days after the Member deletes their account.

  • After that, some personal data may be stored only as long as the law requires or as reasonably necessary for our legal obligations or legitimate interests.

Specifically:

  • We retain your account information as long as your account is active. We retain this data to provide you with access to the Service.

  • We retain booking history data for 5 years to manage disputes, provide customer support, and improve our service. The legal basis for this retention period is our legitimate interest in managing our business operations.

  • We retain payment data for as long as required by applicable accounting and tax laws. The legal basis for this retention period is legal obligation.

6. Transfer of Your Personal Data

Your information, including Personal Data, is processed at our operating offices and in any other places where the parties involved in the processing are located.

This means that this information may be transferred to — and maintained on — computers located outside of Your Country or other governmental jurisdiction where the data protection laws may be different than those from Your jurisdiction.

Your agreement to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

We will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy.

No transfer of Your Personal Data will take place to an organization or a Country unless there are adequate safeguards in place, including the security of Your data and other personal information.

Data Transfers Outside of the EU

If we transfer your data to countries outside the EU, we will ensure that appropriate safeguards are in place. These safeguards may include:

  • The country to which we transfer your data has been approved by the European Commission as having an adequate level of data protection.

  • We have entered into Standard Contractual Clauses approved by the European Commission with the recipient of your data.

  • The recipient is certified under an approved certification mechanism in accordance with the GDPR.

Withdrawing consent may limit your ability to use certain features of the Fullcourt Platform. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

  • Right to rectification: You have the right to ask Us to correct any inaccurate or incomplete personal data we hold about you. You can correct or update some of your personal data through your user account in the Fullcourt Platform.

  • Right to erasure (Right to be forgotten): You have the right to ask Us to delete your personal data from our systems. We will comply with such a request unless we have a lawful reason to retain the data.

  • Right to restriction of processing: You have the right to ask us to restrict the processing of your personal data in certain circumstances.

  • Right to data portability: You have the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format, and to have that data transmitted to another controller.

  • Right to object: You have the right to object to the processing of your personal data in certain circumstances, including processing for direct marketing purposes.

  • Right not to be subject to automated decision-making: You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

You can exercise Your rights by contacting Us using the contact details provided in Section 12. To help Us process Your request, please provide the following information:

  • Your address

  • Your email address

  • A phone number

  • Details of Your request

We may request additional information to confirm Your identity.

We will respond to Your request within 30 days of receiving it. We may reject or charge for requests that are unreasonably repetitive, excessive, or manifestly unfounded.

We use Cookies and similar technologies (e.g., web beacons, pixels, ad tags, and device identifiers) to recognize You and/or Your device(s) on, off, and across different Services and devices.

We may update Our Privacy Policy from time to time.

We will also inform you via email and/or a prominent notice on Our Service, so that you have an opportunity to review the revised policy before continuing to use the Service. We will also update the "Last updated" date at the top of this Privacy Policy.
